Q&A: Does The Joint Commission require individual practitioners to have malpractice insurance?
A: The Joint Commission does not require that a practitioner hold malpractice coverage, but rather leaves it up to each institution to decide whether malpractice coverage is mandatory, and, if so, in what amount and what type.
If coverage is required by the organization's medical staff bylaws, policies, or rules and regulations, then verification of coverage must be obtained.
